On March 17, 2023 the U.S. Department of Housing and Urban Development (HUD) announced that it has submitted to the Federal Register for publication a Final Rule entitled Restoring HUD's Discriminatory Effects Standard.
The Final Rule rescinds the Department's 2020 rule governing Fair Housing Act disparate impact claims and restores the 2013 discriminatory effects rule. In the Final Rule, HUD emphasizes that the 2013 rule is more consistent with how the Fair Housing Act has been applied in the courts and in front of the agency for more than 50 years, and that it more effectively implements the Act's broad remedial purpose of eliminating unnecessary discriminatory practices from the housing market.
This session will cover how the changes in the implementation of the “Rule” impacts Multifamily professionals and offers ten strategies for compliance.

Although several challenges to Disparate Impact are working their way through the courts, as of now, we are subject to compliance with Disparate Impact Theory and successfully navigating the Three Step Burden Shifting Process. In this session we’ll focus on identifying situations where discrimination due to disparate impact might occur and how to minimize the possibility of doing or saying something that could be characterized as discrimination due to disparate impact by using policies, procedures, and training to heighten awareness of potential problem areas. We’ll “walk through” HUD’s Burden Shifting Process as well as demonstrate how to effectively manage the Interactive Process.

Doug was awarded his CPM® in 1979 and was a member of the IREM National Faculty for eight years. A Senior Instructor member of the NAAEI Faculty, he leads the Advanced Facilitator Training course, is the co-author of “Outstanding Facilitation Techniques”, and a co-author of the joint IREM & NAAEI “Fair Housing and Beyond” course.
